General Terms and Conditions

These Terms and Conditions comply with the laws of England and Wales.

1. Acceptance of Proposal

1.1 A proposal is valid for 30 days from its date. To proceed, please accept via the link provided or via email return. A binding contract is only formed upon our written acknowledgment of your order.

1.2 Please carefully review these terms. If clarification is needed, contact us in writing at burkinenergy@outlook.com.

1.3 This agreement is governed by the laws applicable where your property is located.

2. Cancellation Rights

2.1 You may cancel any contract within 14 days (the “Cancellation Period”) without giving any reason and without penalty, provided goods have not yet been delivered.

2.2 To cancel, notify us clearly via email at burkinenergy@outlook.com. Deposits or advance payments made will be refunded if you cancel within the cancellation period.

2.3 If cancelling after the Cancellation Period, you may incur costs or lose deposits/payments made.

3. Our Obligations

3.1 We commit to completing the installation, service or repair with reasonable skill, care, and according to professional standards.

3.2 The equipment we supply will be of satisfactory quality, fit for their intended purpose, and perform as described.

3.3 We accept full responsibility for any contractors engaged by us.

3.4 Installation will adhere to the timetable outlined in your proposal. Delays outside our control (e.g., severe weather) will be communicated promptly, and schedules adjusted by mutual agreement.

3.5 Significant delays within our control entitle you to cancel the contract.

4. Your Payment Obligations

4.1 Deposit: Upon acceptance, a deposit (up to 25% of total price) may be payable. Deposits are refundable if cancelled within the Cancellation Period or if an inspection reveals installation is not feasible.

4.2 Advance Payments: Details regarding advance payments will be outlined clearly in your proposal. Any advance payment combined with the deposit will not exceed 60% of the total contract price unless goods are delivered, transferring ownership to you.

4.3 Final Payment: Balance payment is due upon receipt of invoice. Minor defects do not justify withholding full payment.

4.4 Late Payments: Interest (3% above Bank of England base rate) may be charged on late payments. Significant delays in payment can lead to suspension of installation and recovery of additional costs incurred.

5. Additional Customer Obligations

5.1 Secure necessary permissions (e.g., planning or building consents) prior to installation.

5.2 Provide free access to water, electricity, toilet facilities, storage, and clear site access.

5.3 Complete any necessary preparatory work prior to the scheduled start date.

5.4 Notify us of asbestos presence, which must be professionally surveyed and removed (at your expense) before installation commences.

6. Changes to Agreed Work

6.1 Any proposed changes to agreed work must be communicated and approved by us in writing. Additional costs may apply.

7. Unexpected Work

7.1 Any unforeseen site conditions or special circumstances leading to extra work and costs will be communicated immediately, with costs discussed prior to proceeding.

8. Delivery, Ownership, and Risk

8.1 Equipment may be delivered direct to your specified location.

8.2 Ownership of goods transfers to you upon payment. Until then, goods remain our property and must be kept identifiable and in good condition.

9. Cancellation by Either Party

9.1 Your cancellation rights include cancellation within the cancellation period, significant delays, or breaches by us. Refunds or remedies (repair/replacement/compensation) will be provided accordingly.

9.2 We reserve the right to cancel the contract upon a significant breach by you, after giving reasonable notice and opportunity to rectify.

10. Disputes, Mediation, and Arbitration

10.1 Disputes unresolved amicably may be referred to an independent complaints procedure, including mediation or arbitration. Arbitration decisions are final, legally binding, and enforceable.

Warranty Coverage

Installation/Repair Work: 12 months workmanship warranty.

Products: Covered by manufacturer warranties. Claims facilitated by Burkin Energy.

This agreement is governed by applicable local laws, and disputes will be resolved in courts relevant to your property’s location.
